The Omnibus Bill and public authorities

The Omnibus bill (S 50002, A 40002) passed by the legislature last week (and awaiting the Governor’s signature) provides for the new State income tax architecture, and more relevant to public authorities, it authorizes State entities to use design build contracts (consolidating engineering and construction services) for capital projects in excess of $1,200,000 related to the State’s infrastructure. This new Infrastructure Investment Act (beginning on page 22), prompted largely by the Tappan Zee project, is intended, according to proponents, to hasten implementation, innovation and access to capital for major public works projects. Design build consolidation has been discussed for many years but until recently there was insufficient support/momentum to make it a reality.
